Before doing anything else, Home Owners need to be aware of the statutory warranties that apply to residential building work in NSW. On completion of the work, the statutory warranty period for major defects is six years or two years in any other case. Depending on the warranty period remaining, Home Owners may have no time to consider dispute resolution and may need to lodge a Home Building claim at the NSW Civil and Administrative Tribunal (NCAT) or seek legal advice. Failure to take any action before the expiry of the applicable warranty periods may result in defects being unaddressed by those responsible. Dispute resolution

Class 2 Residential Apartment Buildings

With extensive experience in Class 2 Residential Apartment Buildings, we understand how defects such as water penetration and non-compliant fire safety systems can disrupt the lives of owners and occupants.

We have experience working within the NSW Building regulatory sector during the inception of the once-in-a-generation suite of legislative changes around Class 2 buildings. We understand the design, certification, construction, and legislative processes.

We can commence work with you within days of appointment and work as quickly as the intention of those involved allows, avoiding the protracted and costly effects of conventional approaches.

Once appointed, we can handle the matter on behalf of the Owners and the Strata Manager when dealing directly with the Builder and/or Developer, while keeping the Owners up to date.

Building Defect Investigation and Diagnosis

‍Leaning on years of technical inspections to determine the cause of failure, Back on Track is adept in diagnosing issues related to:

  • Internal wet area waterproofing.
  • External waterproofing such as balconies, planter boxes and control joints.
  • Window, door, and cavity flashings.

Expert witness report

Once all parties are aware of and understand their responsibilities, the way forward is clearer. In our experience, once this is established, the matter rarely proceeds further.

If all efforts to resolve the disputes are exhausted and there is no other option other than litigation, we can provide reports using our knowledge of the National Construction Code – Building Code of Australia, Australian Standards while framed within NSW building legislation. We understand the statutory warranties that apply to defective and or incomplete residential building work and avoid over-servicing for issues that the applicable warranty periods may have expired. This knowledge, fused with integrity and impartiality, ensures support by way of accurate and succinct reports that meet the requirements of the relevant Expert Witness Codes of Conduct for the NSW Civil and Administrative Tribunal (NCAT) and beyond.
